Overview

This is a simple form which can be used by executors and legal personal representatives to notify an insurance company of the death of the insured person. As well as providing notice of the death, the form also includes a request to insurance company that you, the executor, be added to the insurance policy.

This request is very important because executors have a duty to take reasonable care to prevent the depletion of the assets of the estate pending completion of the probate process. It is important therefore, in terms of protecting the assets of the estate and ensuring compliance with the terms of any insurance policy which is in place, to notify the insurance company of the interest of the executor (as trustee of the estate) in any proceeds which are or may become payable to the estate.

This should also ensure that any correspondence from the insurance company will be properly addressed to the executor. This, in turn, should ensure that a situation does not arise where the asset is uninsured and the estate is at risk of depletion.
