The need for both a Healthcare Power of Attorney & a Living Will....
|
A Healthcare Power of Attorney is a legal document that allows you to designate a person (an "Agent") who will have authority to make general health care decisions on your behalf if you are unconscious, mentally incompetent or otherwise unable to make these decisions for yourself. A Living Will, on the other hand, allows you to express your wishes specifically regarding receipt or non-receipt (as the case may be) of "life-sustaining procedures" if you become permanently comatose or terminally ill.
Even if you have executed a Health Care Power of Attorney or Living Will, you still have the right to give medical directions to physicians and other health care providers as long as you are able to do so. These documents only become effective when you do not have the capacity to give, withdraw or withhold informed consent regarding your health care.
Remember, provided you are mentally competent, you can of course revoke your Healthcare Power of Attorney or your Living Will at any time!
What happens if you don't have a Healthcare Power of Attorney or a Living Will? |
If you become unconscious or ill and unable to make decisions regarding your own healthcare, an application may need to be made in order to have you made a ward of court. In such cases, a court will then appoint a guardian who will be given the power and responsibility of making medical decisions on your behalf.
However, there is no guarantee that your guardian will respect any wishes that you may have expressed regarding your medical treatment. This is risky...
- what if you were religiously against blood transfusions?
- what if the guardian authorized amputation against your wishes?
- what if your guardian decided to take a risky operation which could leave you permanently paralyzed or even brain damaged?
The only way to protect yourself is by having both a Healthcare Power of Attorney and a Living Will!
